Terms of Use

These Terms of Use ("Terms") govern your use of the Level Up Performance Training website and anything you buy through it: memberships, camps, packages, sessions, and facility rentals. By using the site or enrolling, you agree to these Terms.

Eligibility

You must be at least 18 to submit an enrollment. Enrollments for athletes under 18 must be completed by a parent or legal guardian, who is responsible for the account and for payment.

Enrollment & payment

Enrollment sets up an athlete account (and, for athletes under 18, a parent or guardian as the responsible party) in MindBody, our scheduling and billing system. Payment is completed on MindBody's secure hosted checkout. Current programs, prices, and any introductory or promotional offers are shown on this site and at checkout. Offers may be limited to new participants, limited in number, or time-limited, as stated with the offer.

Memberships, auto-renewal & cancellation

Memberships are month-to-month, with no long-term contract or minimum commitment. A membership renews automatically each month at the recurring rate shown at checkout, charged to the payment method on file, until you cancel.

You accept a membership agreement at checkout. It sets out your plan, your rate, your billing dates, and the terms of any introductory offer, and it controls if it differs from these Terms. A rate described as locked (for example, a founding rate) stays the same for as long as that membership remains continuously active.

Cancellation. You may cancel at any time by emailing jesse@levelupperformancetraining.com from the email on your account. Unless your membership agreement says otherwise, cancellation takes effect 30 days after we receive your notice, and any payment that falls due within that period is still charged.

Camps, packages, sessions & rentals

Camps, class packages, single sessions, and facility rentals are one-time purchases. What's included, the dates or period they're valid for, and any member pricing are shown at purchase. Camp spots are limited and are held once payment is complete.

Refunds & price changes

Except where these Terms, your agreement, or applicable law (including California law) provide otherwise, payments are non-refundable. Prices and offers may change at any time; changes apply going forward and never to a rate you've been promised is locked.

Photos & video

We photograph and record training sessions and events as described in our participation waiver and membership agreement. For athletes under 18, we do not post a last name, school, or contact information without separate written permission. You can opt out at any time by emailing jesse@levelupperformancetraining.com.

Acceptable use

You agree to provide accurate information, to use the site only for lawful purposes, and not to attempt to disrupt, damage, or gain unauthorized access to the site or its systems.

Health & participation

Training and physical activity carry inherent risks. Participation is subject to any waivers, releases, and health acknowledgements Level Up requires. Consult a physician before beginning any new exercise program.

Intellectual property

The Level Up name, logo, and site content are owned by Level Up or its licensors and may not be used without permission.

Third-party services

Our enrollment and payments rely on MindBody and other third-party services, which have their own terms and privacy practices. We are not responsible for third-party services.

Disclaimers & limitation of liability

The site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Level Up is not liable for indirect, incidental, or consequential damages arising from your use of the site.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in San Mateo County, California, and you consent to the personal jurisdiction of those courts.

Changes

We may update these Terms from time to time; updates will be posted here with a new "Last updated" date.
